The Professional Credit Downturn Course

The Professional Credit Downturn Course is a daylong combination of lecture, discussion, exercises, real world examples, and group case studies. It addresses how to handle weakening loans to medical, law, and accounting practices, including applicable credit analysis, legal, and negotiation issues.

This course should be taken by professionals with some credit background who would like to improve their ability to deal with professional practice credits. It is designed to benefit individuals in lending, credit policy and analysis, credit review, workout, and regulatory positions.

The course is structured to “bring you to the table” with confidence, armed with the strategies and skills to handle the most difficult situations. You will make the right decisions to minimize any potential charge-off loss and thus maximize your contribution to your institution. We will discuss several varying types of live cases, including one where a bleak situation was transformed into a very profitable relationship for the bank, with an increased level of client loyalty.

Loan Structuring

  • Ratio analysis.
  • Types of loans and other credits.
  • Security.
  • When are covenants appropriate?
  • Guaranties.
Module 3: Legal and Regulatory Issues
Prior to Bankruptcy

  • Methods of protecting assets, such as attachment and perfection.
  • Judgments and fraudulent conveyances.
  • Workouts and collective creditor actions.
Module 4: Identifying Potential Problems

  • Importance of cash.
  • Signs and signals of a weakening credit.
  • Mini-case exercises.
Module 5: Workout Techniques
  • Developing a strategy.
  • Increasing management cooperation.
  • Protecting the collateral.
  • Using “events of default” wisely.
  • Restructuring the loan.
  • Dealing with other creditors.

Module 6: Case Study - Working With
Management in a Downturn

Module 7: Overview of Bankruptcy Law

  • Chapter 7- Liquidation.
  • Chapters 11 and 13- Reorganization.
  • Exercises.

Module 8: Final Case Study

All participants receive a copy of the course manual, which is also useful for taking notes during the class.
